At the Krome North Processing Center in Miami, detained women have described their treatment and living conditions as “inhumane and life-threatening.” These women were here legally, holding visas or permanent resident status, with no criminal background.

I keep seeing these anxious posts bubbling up from the swamp of doom-scrolls, clutching their pearls about April 20th—the day, supposedly, when the Trump regime will dust off the Insurrection Act like a vintage bottle of fascism, smash it open on the table, and toast to martial law. Constitutional rights? Suspended. Civil liberties? Vaporized. America? Repackaged as a theocratic police state with a God complex and a meth addiction.
And sure, the evidence pointing in that direction? Compelling. Chilling, even. But let’s not confuse “possible” with “inevitable,” and let’s certainly not confuse “dangerous” with “invincible.” This is not some fucking Marvel movie where the villain has a flawless plan. No, this is a clown car of egomaniacal sycophants with the strategic acumen of a toddler playing Risk while hopped up on Pixy Stix. They’re busy gutting their own institutions, firing people with triple-digit IQs, and turning the Pentagon into a goddamn golf club for grifters. This is not the Death Star. It’s a flaming dumpster strapped to a roller coaster with no brakes.
Let’s get one thing straight: I’m not saying it won’t be chaos. It will be. Hell on Earth with a Wi-Fi connection. But let’s not pretend this bloated, crumbling regime has the organizational prowess or ideological unity to maintain a long-term crackdown on 330 million people, many of whom are smart, pissed-off, and crazy enough to throw sand in the gears.
But here’s the meat of it—I’m not here to play Nostradamus in a dive bar. I don’t give a damn about “predicting” what flavor of fascism they’ll try to bottle next. What I am here for is to speak directly to those of you who see the bullshit, who smell the sulfur in the air, who feel the psychic tremor of something sick pulsing beneath the surface—and are asking: What the hell can we do?
Here’s my answer:
Don’t. Fucking. Comply.
You want to know what non-compliance looks like? It looks like whatever the hell you want it to look like. It’s not about heroism or martyrdom. It’s about being a magnificent, ungovernable pain in the ass. It’s about weaponizing inconvenience, absurdity, and joy against a system that demands fear and obedience.
Throw a wrench in the works—everywhere, all the time. Go limp when they try to arrest you. Laugh like a lunatic in the face of their solemn tyranny. Fill their inboxes with existential poetry or pictures of your morning post-coffee porcelain bowl masterpieces. Tape absurd messages in public places: “Authoritarianism gives you hemorrhoids.” Get petty. Get weird. Flush their toilet paper. Release crickets in inconvenient places. Spoil their scripts, trip their rhythm, yank the narrative from their hands.
Join a general strike. Practice the black cat sabotage—cut their supply chains not with violence but with broken protocol and creative disorder. Don’t show up. Don’t respond. Don’t cooperate. Don’t validate their authority with your silence. If you’re going to get arrested, make it for being a glorious bastard who refuses to play their game. Make a mockery of it.
Because here’s the ugly truth they don’t want you to hear: authoritarianism only works when the people allow it to work. It’s a performance, a bluff, a collective hypnosis. Break the spell. Break the frame. Mock it. Undermine it. Set it on fire (proverbially) with your refusal to kneel.
But here’s the thing—this has to be everywhere. Everyone. If you sit back, clutch your pearls, and hope someone else will jump first—you’re part of the problem. This isn’t Putin’s Russia (yet). We don’t need a handful of martyrs; we need a flood. A tsunami of “nope.” A wildfire of “fuck you.” We need resistance so widespread, so creatively chaotic, so utterly unmanageable, that the regime cracks under the weight of its own overreach.
History is watching. But more importantly, your children are watching. And if you let a pack of psychotic Bible-thumping oligarchs jackboot over your rights while you nervously refresh Twitter and do nothing—then don’t be surprised when the future looks back and calls you exactly what you were: a coward.
Choose better. Be bold. Be clever. Be feral.
And above all—DO NOT COMPLY.
And let me be crystal clear here: NO violence. None. Not a shred. That gives them the excuse they’re desperately craving to justify tyranny. What we need is coordinated, irritating, clever-as-hell, petty-as-fuck, infuriating noncompliance. Be a stone in their shoe. Be sand in their eyes. Be a bureaucratic migraine. Drive them nuts—but never give them the moral high ground. This is about outsmarting them, not becoming them.

Speak out against these EOs: Criticize these EOs and the Trump administration when their actions conflict with your organization’s mission. 501(c)(3) nonprofits must remain nonpartisan, which means they cannot support or oppose candidates for office, but Trump is no longer a candidate. Talk to your congressmembers and call them to take action and not stand for these EOs. Urge your members to speak up and serve as checks to the executive branch’s power.
Under Internal Revenue Code (IRC) rules, advocacy for or against executive branch action is not lobbying. This means all of this great advocacy does not count towards the lobbying limits of 501(c)(3) public charities, and any funds you receive that prohibit lobbying (from private or public foundations, for example) can likely be used for executive branch advocacy. Even if you are talking to congressmembers, if you are asking them to speak out against executive action (not legislative action), that will not count as lobbying. Note that the federal Lobbying Disclosure Act and state and local lobbying disclosure laws may include executive branch advocacy in their lobbying definitions, which often differ from the IRC’s lobbying definitions. When they do, these lobbying disclosure laws could require you to register or report your executive branch work along with your legislative activities, but they will not likely restrict it. Litigate: join in lawsuits, like the one already filed against the funding freeze or the birthright citizenship ban. Work with counsel to file new lawsuits based on the impacts that these actions have for you as an organization and for your communities.

Lobby: 501(c)(3)s public charities and 501(c)(4)s can lobby! Lobby against Trump’s cabinet nominees who are before the Senate. Pete Hegseth has been confirmed as Secretary of Defense and is now in charge of the military’s DEI policy (or lack thereof). Stop these nominees where they are and don’t let them through the Senate. You can also lobby the House and Senate for new laws to protect your communities. Many of Trump’s EOs are easily undoing prior Biden EOs because EOs do not have the same protection as a law passed through Congress. If something is a priority for you, lobby for it to be made into law that cannot be so quickly overturned.

Judicial advocacy: Trump’s funding freeze and birthright citizenship ban were stopped in their tracks due to the great work of judges. It is so important to continue to advocate to have good judges seated because they serve as a safeguard against problematic executive orders and other executive branch actions. Remember, advocating for Senators to vote for or against judicial nominees is considered lobbying that needs to be counted against a public charity’s IRS lobbying limits. Work at the state level: If you have a state government that is more favorable towards your values, work with them more closely. Encourage greater state funding of nonprofits that cannot be revoked by the federal government. Work to get laws passed at the state level to protect your work. For example, Trump revoked the electric vehicle goals, but California still has a requirement in place that all new cars be zero emission by 2035.

Fund, fund, fund: if you are at a foundation, this is a great time to increase funding for organizations who may be experiencing gaps in funding due to Trump’s actions — even as their services are more necessary than ever. Encourage your grantees to use your funds to advocate against EOs (a great non-lobbying use of funds). If you are at a public charity that receives government funds and are impacted, consider diversifying or changing the sources of your funds to prevent against the impact of future freezes or limits imposed by federal funding.

Step up: the Trump administration made clear that ideals like DEI will not be prioritized and will be attacked. The federal government will not be engaging in the DEI work that they previously did, so nonprofits that do not rely on federal funds should step up to fill the gaps. AFJ’s Building the Bench work is a great starting place to get involved with seating diverse and representative judges. DEI still needs to exist, because systemic racism and sexism will always exist whether the current administration believes it or not.

Stand strong: Nonprofits, especially ones who do not need federal funding, are the last line of defense. Continue your great work and support your colleagues who may be struggling. Be loud, stand strong, and reach out to our Bolder Advocacy team if you have questions regarding your nonprofit’s ability to engage in executive branch and legislative advocacy.

Get out and protest: Nationwide “Hands Off!” demonstrations are planned on April 5 in Washington and at sites around the country to demand that Donald Trump and Elon Musk stop vandalizing our government. Ideally, go to the Washington event to help create large crowds that the media can snap pictures of. If not, find an April 5 protest near you – or organize one.

Support those who fight, not those who fold: Support those pushing back aggressively against the rise of fascism. They include Rep. Alexandria Ocasio-Cortez, Illinois Gov. JB Pritzker, Sen. Bernie Sanders, Rep. Jamie Raskin, Rep. Jasmine Crockett, and others. Don’t wait for Schumer & Co. to get serious. Show them the way. That’s what at least 30,000 people did in Denver on Friday for AOC and Sanders’ Fighting Oligarchy tour. There were huge crowds at other western tour stops as well.

Lobby the media: Believe it or not, journalists are human. They’re affected by feedback from the public, if it’s stated well. Write an email or send an actual letter with a stamp on it. Write to them when they do a good job. They probably don’t get much of that. If you’re complaining about their work, be polite, brief, and specific. Tell them how they can do better next time.

Cancel bad media: The Washington Post is dead to me now. For a long time, I considered it a vital publication. But owner Jeff Bezos flushed away its credibility to suck up to Trump. I canceled my subscription this month. I’m also fed up with CNN and MSNBC’s “Morning Joe.”

Reward good media: Shutting off all media would be a very bad idea right now. Support the good ones, many of which welcome your subscriptions or donations. They include ProPublica, Guardian US, The New Republic (featuring Greg Sargent’s sharp podcast and Timothy Noah’s superb essays), “Democracy Now,” COURIER, USA Today’s Rex Huppke, Steven Beschloss’ “America America” newsletter, and the Open Windows newsletter by Ann Telnaes, the cartoonist who quit the Washington Post after her bosses killed her cartoon criticizing Bezos.

Call congress: They count the number of calls and emails they get on issues. The phone number for the main U.S. Capitol switchboard is (202) 224-3121. If your members of Congress won’t pick up or take voice mail, they may accept email.

Support the legal fights: Lawyers are on the front lines in the battle for the rule of law. They need our support. One of the best is Marc Elias, who has been suing and winning against Republican voter suppression for years. He’s the founder of Democracy Docket, which tracks and publicizes these cases. It offers memberships. Meanwhile, the New York Times is tracking legal action against the Trump regime.

Boycott bad actors: One of the most powerful weapons that ordinary people have is their buying power. Obviously, you can’t boycott everything. I don’t condemnpeople who want to see pictures of their grandkids on Facebook. But I’m trying to wean myself off the platform because Mark Zuckerberg has surrendered to Trump. My main boycott targets are Tesla (of course) and Uline shipping supplies. Uline is owned by Dick and Liz Uihlein, who have bankrolled a variety of anti-democratic efforts, including 2020 election denial. The boycott is a celebration of the free enterprise system. Use it.

Don’t let state borders limit your activism:The midterms are 20 months away, but there are elections going on in various places at various times before then. Wisconsin, for example, has a crucial Supreme Court race on the ballot on April 1. Elon Musk has helicoptered in to drop millions of dollars into the race. There’s nothing stopping those of us who oppose Musk from donating to the candidate he’s opposing.

Stay loud:It’s vital for democracy defenders to find allies and show strength in numbers. Stay active on social media (I’m on Bluesky), and keep letting your family and friends know where you stand. With all the MAGA-manufactured chaos in Washington, some Republican voters are having second thoughts. We’ve got to take advantage of the opportunity.

Trump didn’t even win a majority of the popular vote, but he wants to create a sense of inevitability. It’s our duty to explode that myth – to wield the awesome power of citizens who love our democracy.

Many of you have reached out to the Lemkin Institute for Genocide Prevention and Human Security to ask what you can do in the face of what appears to be an authoritarian coup against the US Constitutional order, driven and overseen by a President and a billionaire who gave the Nazi salute at the President's inauguration, and deeply infected by the genocidal thinking of many conservatives and evangelicals, targeted mainly at immigrants of color and trans people (for the time being).
